Terms of Service

Introduction
These Terms of Service (hereinafter referred to as "Terms") govern use of SharePot (hereinafter referred to as "the App"). By downloading or using the App, you and the End-User agree to be bound by these Terms. If you are under 18 years of age, please obtain consent from your guardian before using the App.
Matters Regarding Apple
Except as otherwise provided in Section 16 of these Terms, these Terms are concluded between you and us only, and not with Apple Inc. or its affiliates (collectively, "Apple"). We, not Apple, are solely responsible for the Licensed Application and the content thereof. You acknowledge that you have had the opportunity to review the Apple Media Services Terms and Conditions.
Acknowledgement
You and the End-User acknowledge that these Terms are concluded between You and the End-User only, and not with Apple, and You, not Apple, are solely responsible for the Licensed Application and the content thereof.
Scope of License
The license granted to the End-User for the Licensed Application must be limited to a non-transferable license to use the Licensed Application on any Apple-branded Products that the End-User owns or controls and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
Maintenance and Support
You must be solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms, or as required under applicable law. You and the End-User acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
Warranty
You must be solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. These Terms provide that, in the event of any failure of the Licensed Application to conform to any applicable warranty, the End-User may notify Apple, and Apple will refund the purchase price for the Licensed Application to that End-User; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Your sole responsibility.
Product Claims
You and the End-User acknowledge that You, not Apple, are responsible for addressing any claims of the End-User or any third party relating to the Licensed Application or the End-User's possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with Your Licensed Application's use of the HealthKit and HomeKit frameworks. These Terms may not limit Your liability to the End-User beyond what is permitted by applicable law.
Third Party Terms of Agreement
The App uses the following third-party services. The End-User must comply with applicable third party terms of agreement when using the App:
- Firebase (Google): Firebase Terms of Service
- Google Analytics: Google Analytics Terms of Service
- Google: Google Terms of Service
Legal Compliance
The End-User must represent and warrant that (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.
Third Party Beneficiary
You and the End-User acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon the End-User's acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against the End-User as a third party beneficiary thereof.

Definitions
The following terms are defined as follows in these Terms:
- The App: SharePot application subject to these Terms
- User: Individual who uses the App
- Invite Code: Invitation code posted by user or information thereof
- Anonymous UID: Device-based identifier to identify users
- These Terms: These Terms of Service in their entirety
1. Service Provision
The App provides an anonymous community bulletin board service where users can post, view, and use invitation codes. The content of the service may be changed without prior notice.
- Target Age: The App is intended for users aged 13 and over. Users under 18 must obtain guardian's consent before using the App.
- Target Region: Service is intended to be provided in Japan, but may be accessed from overseas via the internet.
- Free Service: The App is provided free of charge. No usage fees will be incurred.
2. License Grant
The App is not sold but grants you a non-exclusive, non-transferable right to use it. You may use the App under the following conditions.
- Scope of Use Right: The App may be used for personal use purposes only. Commercial use or transfer to third parties is prohibited.

Prohibited Activities: The following activities
are prohibited:
- Reverse engineering, disassembly, or decompilation of the App
- Analysis or modification of the App's source code
- Concurrent use of the App (including multi-playing)
- Limitation on Copying: The App is limited to one installation per device.
- Third-Party Rights: Third-party intellectual property rights contained in the App belong to their respective owners.
3. User Registration and Authentication
The App uses an anonymous UID-based authentication system, and no personal information registration is required. However, we may collect device identification information to prevent fraudulent activities.
4. User Obligations
You agree to the following obligations:
- Comply with the one post per day rule
- Provide accurate and truthful information
- Respect other users
- Not infringe on the rights of other users
- Comply with laws and these Terms
5. User-Generated Content Provisions
Rights and obligations regarding invitation codes posted by users (hereinafter referred to as "User-Generated Content") are as follows.
- Ownership of Rights: Rights to User-Generated Content belong to the user who posted them.
- License: You grant us a non-exclusive, free, worldwide right to use the content you post. This allows us to display and use the content through the App.

Deletion Right: We have the right to delete
User-Generated Content in the following cases:
- If it violates these Terms or laws
- If there is a report of rights infringement by other users and it is deemed infringing based on reasonable judgment
- If it violates public order and morals
- No Monitoring Obligation: We are not obligated to monitor or censor User-Generated Content. We will respond only when inappropriate content is reported.
6. Intellectual Property
All intellectual property rights related to the App belong to us. You may use the App only for personal use purposes.
7. Disclaimer and Limitation of Liability
The App is provided "AS IS" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We are not liable for the following.
- Validity of Codes: We are not responsible for the validity, expiration date, or usage conditions of posted invitation codes.
- Service Interruptions or Failures: We are not responsible for temporary interruptions, delays, or other technical issues of the service.
- Disputes Between Users: We are not responsible for disputes, troubles, or losses arising between users.
- Changes or Termination of Service: We are not responsible for any changes, temporary suspension, or complete termination of all or part of the service.
- Damage from Information Deletion: We are not responsible for damage caused by deletion of User-Generated Content or account information.
- Third-Party Content: We are not responsible for any issues related to third-party websites, services, or products.
- Device Issues: We are not responsible for issues with your device, software, or network environment.
Limitation of Liability
Except in cases of willful or gross negligence by us or its related parties, the maximum liability we assume for any damages related to this service is limited to the total amount of usage fees you have paid for the service in the past three months (1,000 yen if the said amount is less than 1,000 yen).
8. Account Management
You may manage your account at any time. Account reset is available at any time, but re-authentication with a new anonymous UID is required after reset.
- Account Reset: You may reset your account at any time. Resetting will delete all data including profile, post history, and report status.
- Transfer: We provide features to transfer your account to another device. Transfer codes are valid for 30 minutes and must be reissued after expiration.
- Reposting: After resetting your account, you can immediately start posting with a new account. No waiting period for date change is required.
9. Changes or Termination of Service
We may change or terminate all or part of the service without prior notice. In such cases, we will not be liable to you.
10. Measures for Violations
If you violate these Terms or engage in inappropriate behavior, we reserve the right to take the following measures.
- Warning: We will send a warning depending on the nature of the violation.
- Content Deletion: We will delete the violating content.
- Account Suspension: In case of serious violation or repeated violations, your account may be temporarily or permanently suspended.
- Legal Action: If there is illegal activity, we may take legal action.
11. Changes to Terms
We may change these Terms from time to time. The revised Terms will become effective upon notice in the App. We will provide separate notification for significant changes.
12. Separability
If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force and effect. If there is no replacing provision for an invalid provision, that portion shall not apply.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with Japanese law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of Tokyo District Court or Chiba District Court for the first instance.
